General

These terms and conditions, together with any other written information brought to your attention before we confirm your booking, shall form the basis of your contract with The Dram Queen (‘us’, ‘we’, or the ‘Company’) in respect of the relevant Scotch whisky experience, tourism experience or consultancy service (together referred to in these terms and conditions as “experiences “) to be provided by the Dram Queen.

Please read these terms and conditions carefully and contact us if you have any queries.

Within these conditions, ‘you’ and ‘your’ means all persons named on the booking.

By making a booking, the ‘lead passenger’ specified in the booking will be deemed to have accepted these conditions on behalf of all passengers within the booking.

The Dram Queen endeavours to ensure that the information and prices on the website and any information provided are accurate. However occasionally changes and errors occur, and the Dram Queen reserves the right to correct prices and other details in such circumstances.

You should check the current price and all other details relating to the arrangements that you wish to book before your booking is made.

All experiences are sold subject to availability.

Governing Law and Jurisdiction

These terms and conditions shall be governed by and construed in accordance with Scots law and any matter or claim arising from them shall be dealt with only in the Scottish Courts.

The terms of these terms and conditions constitute a legally binding contract (the ‘Contract’) between you, (‘the Client’) and The Dram Queen (‘the Company’).

No failure or delay by The Dram Queen in enforcing any of its rights under the Contract shall be deemed to be a waiver of such right.

Bespoke whisky experiences which are NOT booked online

The Dram Queen welcomes the opportunity to provide exclusive, private, or bespoke experiences. If you wish to discuss one, please contact the Dram Queen by emailing ann@dramqueen.co.uk in the first instance to discuss your requirements further.

Proposals and Quotations

Once the Dram Queen has ascertained what the client would like to include in the bespoke experience, she will send a written Proposal containing full details plus a Quotation including the total fees and anticipated expenses as well as details of the deposit required to secure the reservation, for the client’s consideration.

Bespoke private Scotch whisky experiences are based on the quotation provided to each client for their specific experience and are exclusive to the booked group only.

UK licensing laws mean none of the Dram Queen’s Scotch whisky experiences are suitable for those under the age of 18 years.

Confirmation of Bookings

Your booking will be confirmed when you accept the Dram Queen’s Quotation in writing or by email and payment of the deposit is received. At this point the Dram Queen will issue a Booking Confirmation and a binding contract will be entered into between the parties.

A booking confirmation will only be issued once full or part payment from the client has been received, as indicated in these terms and conditions. The Dram Queen cannot be held responsible if any experience in which a client is interested becomes fully booked or otherwise unavailable prior to payment being received.

Payments

All prices will be quoted in British pounds sterling.

A deposit is required to confirm all bookings which is usually 50%. Full payment for all these experiences is required 14 days before the start date of the experience or tour.

For bookings made less than 14 days before the start of the experience the full amount is due to secure the reservation.

The Dram Queen reserves the right to recalculate pricing due to fluctuations in the market between the time a fully costed proposal is issued, and the deposit or balance of the fee is paid.

The Dram Queen requires payments to be made in British pounds sterling by international or national bank transfer [or with prior notice by PayPal] using the details included in the invoice.

Payment of deposit or full payment will constitute acceptance of The Dram Queen’s Terms and Conditions.

Cancellations and Changes By the Dram Queen

The Dram Queen undertakes to fulfil all experiences as booked but reserves the right to cancel, change or curtail an experience due to unforeseen circumstances, illness, injuries, or events beyond her control at any time. In such circumstances you will be entitled to a full refund of all payments made in respect of the experience or you may transfer to an alternative experience of the same value at no additional cost.

This refund will be an end to any obligation on the Dram Queen’s part. Liability for costs or inconvenience if the Dram Queen fails to deliver an experience is limited to the total value of the experience purchased. Alternative dates will always be offered if possible. The Dram Queen cannot be responsible for any other costs customers may incur such as transport, accommodation, and travel expenses.

Client Cancellations & Refund Policy

The Dram Queen accepts that unforeseen circumstances can also affect clients who may be forced to cancel booked experiences. She will always try to accommodate a change of date when an experience has been reserved. No charges will apply to date changes if an alternative is available. However, if no alternative date is available then the cancellation charges listed below will apply. Every effort is always made to keep cancellation charges as reasonable as possible. However, customers are recommended to consider appropriate travel insurance with cancellation cover.

All cancellations must be made by email or in writing, and cancellations will be effective from the date the written/email notification is received.

Please note that the Dram Queen reserves the right to retain a standard fee of 20% per person of the booking fee to cover administration costs in addition to a fee for any additional non-refundable outlays or supplier costs already incurred by the Dram Queen.

For all bespoke experiences or services:

Cancellation more than 30 days before the start date of the experience – full refund less administration fee of 20% per person of the total and any non-refundable outlays or cancellation fees for supplier costs.

Cancellation between 30 -14 days before the start date of the experience – 50% refund of full amount paid, less administration fee and any outlays (subject to non-refundable or cancellation supplier costs).

Cancellation less than 14 days before the start date of the experience – No Refund

Insurance and Liability

The Dram Queen strongly recommends that all clients arrange suitable travel, medical and cancellation insurance. The Dram Queen will not accept responsibility for the loss or damage to any personal possessions.

All Experiences

All events are based on a minimum number of people as set out in the Quotation.

Programmes for experiences will be as agreed between the Dram Queen and the client/s. However, the Dram Queen reserves the right to change programmes if weather or travel require it.

Experiences start at agreed times, and guests are requested to arrive on time to ensure they can make the most of their experience. Failure to appear at an agreed start point and/or at an agreed start time for an experience will constitute a cancellation with no refunds given.

Please note that UK licensing laws mean it is not possible to accept children under 18 years on any of the Dram Queen’s experiences.

The Dram Queen Experiences in the Dram Queen’s Dram Room

Events in the Dram Queen’s own Dram Room are for a minimum of 4 and generally a maximum of 12 people.

They include the use of tasting mats, tasting glasses and provision of tasting samples.

Dram Queen Experiences in a location organised by the client

Minimum charges for events at a location organised by the client will be set out in the Quotation.

Where required at a location organised by the client, tasting glasses, and tasting mats can be supplied and a modest charge may be made for their use.

Where required at a location organised by the client, bottles of whisky for tasting samples can be provided and a 20% service charge may be added to the purchase price.

Travel expenses incurred to reach locations organised by the client will be estimated in the Quotation and added to the final invoice. An additional charge may be made for any journeys of more than an hour.

Special Requests

Any special requests should be advised to the Dram Queen at the time of booking.

Whilst she will always try to accommodate your special requests within reason, the Dram Queen cannot guarantee that it will be possible to fulfil them.

Failure to meet any special request will not be a breach of contract on her part.

Disabilities and Medical Problems

The Dram Queen will always try to accommodate disabilities and medical problems where possible.

If you or any member or you party has any disability or medical problem which may affect their ability to enjoy the Dram Queen’s experiences, please provide full details at the time of making your booking enquiry, so you can be advised as to the suitability of your chosen arrangements.

Children

UK Licensing laws mean that the Dram Queen cannot allow children under the age of 18 years to participate in any of her Scotch whisky experiences.

Smoking

Smoking or vaping is not permitted on the Dram Queen’s premises or during any of her experiences.

Feedback and Testimonials

The Dram Queen actively welcomes your feedback and testimonials, both in respect of her own services and those provided by other suppliers.

Complaints

In the event that you have any complaint during the course of your tour then please bring this to the Dram Queen’s attention as soon as possible and she will endeavour to resolve the matter to your satisfaction.

Data Protection

To process your booking and to ensure that your arrangements run smoothly, the Dram Queen will need to use the personal information which you provide. Your information will not be passed to anyone who is not involved in providing any product or service related to your booking.

Tourism Experiences

In addition to the provisions above the following will apply to Tourism Experiences:

  1. Tourism Experiences are priced, quoted, and sold exclusive of all admission fees, tastings, tours, and meals unless specifically detailed in the quotation.
  2. Where reservations are made on behalf of the client, private tours may incur an arrangement fee and payment of non-refundable charges to cover non-refundable outlays incurred on the client’s behalf.
Consultancy Services

In addition to the provisions above the following will apply to Consultancy Services:
